1. Scope of contract
The following general terms and conditions are valid for all orders placed via our online shop.
2. Contract parties, contract conclusion
The contract is concluded with LA SIESTA GmbH.
By uploading products to our online shop we make a binding sales offer for those products. You can put our products into the shopping cart without obligations and you can correct your entries before placing a binding order any time by using the designated and described correction measures in the checkout process. The products contained in your shopping cart will be ordered conclusively after clicking on the order button. We will acknowledge receipt of your order by sending you an automatically generated email accepting your order.
3. Contract language, contract text storage
The contractual language is English.
We store the contract text and send you order details and General Terms and Conditions by email. You can also review our General Terms and Conditions online on this site. For safety reasons, previous orders are no longer accessible online.
4. Terms of delivery
Product prices are stated without delivery cost. Delivery cost will be charged separately. More information about delivery cost can be found under shipping information.
We do not deliver to parcel collection stations or post offices.
5. Payment
Payment for goods can be made by one of the following payment methods:
Some payments in our web shop are processed by the external payment service provider Mollie (Mollie B.V., Keizersgracht 121, 1015CW Amsterdam, Netherlands, register number: 302.04.462).
The payment details entered by you are forwarded both to Mollie and to the respective payment service provider. Your details are transmitted to Mollie in order to execute and/or initiate the purchase agreement. Mollie itself acts as the controller for the purpose of data protection. Customers can use one of the following payment methods offered by Mollie: credit card (Visa, Mastercard, American Express).
Credit card
You submit your credit card details to us at the time you place the order.
Directly after your order submission and after verification that you are the rightful owner of the credit card, weāll ask your credit card company to issue the payment. The payment transaction is automated by the credit card company and your credit card will be charged.
PayPal
During the checkout process you will be forwarded to the website of the payment service PayPal. You need to be registered with PayPal to make the payment. This requires a legitimation with your personal PayPal login details and additional confirmation to finally issue the payment on PayPalās website. After the receipt of your order in our shop weāll ask PayPal to issue the payment to us. You will receive additional information during the checkout process.
The payment transaction via PayPal is an automated process made immediately afterwards.
Klarna
In cooperation with Klarna Bank AB (publ), SveavƤgen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

Payment with BLIK
With BLIK you pay securely and directly through your banking app. Select BLIK as your payment method at checkout, open your app and enter the six-digit BLIK code. Once confirmed, the amount is immediately debited from your account. The payment is processed in real time, allowing us to handle your order right away.
Payment with MobilePay
MobilePay makes it quick and easy to pay with your smartphone. When selecting MobilePay at checkout, you will be redirected to the MobilePay app. There you can review the payment details and confirm the transaction with a simple swipe. The amount is debited immediately, and your order will be processed without delay.
Payment with TWINT
TWINT is the most popular mobile payment method in Switzerland. When choosing TWINT during checkout, the TWINT app opens automatically or you can scan the displayed QR code. Once you confirm the payment, the amount is debited instantly. Thanks to real-time processing, we can handle your order immediately.
6. Return
You have the right to cancel your purchase within 100 days without having to give a reason! It starts on the day you or a third person named by you and is not the carrier, received the goods.

To comply with the cancellation period it is sufficient to message your intention to cancel the contract within the cancellation period.
Cancellation consequences
Ā If you withdraw from this contract, we will refund the purchase price of the returned item. The original shipping costs to you will not be reimbursed.
The refund will be made immediately and at the latest within fourteen days of the returned item being received by us.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day you notify us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period expires.
You are responsible for the return shipping costs unless the item is defective or faulty.
In the event of a withdrawal, we will provide a return label upon request. The cost of the label will be charged to you. Alternatively, you can return the item to us independently at your own expense.
7. Reservation of Proprietary Rights
All goods remain our property until fully paid.
8. Transport damages
In case goods are delivered with evident transport damage, you need to file a claim with the deliverer immediately upon receipt and contact us as soon as possible. To miss filing a claim or to contact us does not have any consequences for your legal rights, legal rights enforcement or warranty. But you would help us enforcing our own rights towards the delivery service or insurance company.
9. Warrantee and Guarantee
If not clearly stated otherwise below, the legal liability for defects is valid.
The period of limitation for liability claims for used goods is one year after delivery of the goods.
The preciding restrictions and reductions of the period of limitation are not valid for damages that are caused by us, our legal representatives or servants
- for death or personal injury arising from our negligence
- for fraudulent misrepresentation,
- for breach of the cardinal obligations, which are necessary to fulfill the contract properly and that the contract partners can generally trust to be kept (cardinal obligations)
- for liability promises, as agreed upon
- as far as the scope of the legal product liability is applicable
Information about additional guarantees that might be applicable and the exact scope of the guarantee is stated in the product description and on separate informative pages in the online shop.
10. VAT exemption
VAT exemption applicable to exports for non-commercial tourist traffic is excluded. This applies in particular to third countries outside the EU such as Switzerland.
11. Liability
We have unlimited liability for claims resulting from damages that are caused by us, our legal representatives or servants
- for death or personal injury arising from our negligence
- for fraudulent misrepresentation,
- for liability promises, as agreed upon
- as far as the scope of the legal product liability is applicable
In case cardinal obligations of the contract are breached and which the contract partners can usually trust to be met and which need to be met to enable a proper contract fulfillment, whether by slight negligence by us, our legal representatives or servants, the liability is limited to the damage that can typically be anticipated at the time of the contract conclusion. Further compensation for damages is excluded.

We are neither bound nor willing to take part in any settlement action before a consumer arbitration board.
